Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the Rush Mail platform, API, and related services (the “Services”). By creating an account or using the Services, you agree to these Terms. This document is a draft template provided for review by qualified legal counsel and should not be relied upon as legal advice.
1. The Services
Rush Mail provides infrastructure for producing and mailing physical documents, including letters and certified mail, along with address verification and delivery tracking. You are responsible for the content you submit and for ensuring you have the right to send it.
2. Accounts
You must provide accurate account information and keep your API credentials secure. You are responsible for all activity that occurs under your account and credentials.
3. Acceptable use
You agree not to use the Services to:
- Send unlawful, fraudulent, or deceptive material;
- Violate the rights of any third party;
- Circumvent postal regulations or applicable mailing requirements;
- Send content you are not authorized to send.
4. Fees and payment
The Services are billed on a per-piece basis, with postage and carrier fees passed through. Fees are due according to the plan and billing terms presented at sign-up. Postage is non-refundable once a piece is inducted into the postal stream.
5. Delivery
Rush Mail produces and inducts mail into the carrier network but does not control final delivery, which is performed by the United States Postal Service. We do not guarantee delivery times and are not liable for carrier delays, losses, or non-delivery beyond our reasonable control.
6. Service levels and availability
The Services are provided on a commercially reasonable basis. Specific service-level commitments, if any, are set out in a separate agreement for enterprise customers.
7. Confidentiality and data
Each party will protect the other's confidential information. Our handling of personal data is described in our Privacy Policy. For customers handling protected health information, a Business Associate Agreement is available.
8. Warranties and disclaimers
Except as expressly stated, the Services are provided “as is” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability
To the maximum extent permitted by law, Rush Mail will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising from your use of the Services.
10. Termination
Either party may terminate access in accordance with the applicable plan terms. We may suspend the Services for violations of these Terms or to protect the integrity of the platform.
11. Changes
We may update these Terms from time to time. Material changes will be communicated through the Services or by email. Continued use after changes take effect constitutes acceptance.
